By accessing or using Z-Scope PRO ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

1. Definitions

"Service" means the Z-Scope PRO web application, dashboard, and all related features accessible at zscope.org. "User" means any individual who accesses or uses the Service. "Content" means all data, analyses, scores, alerts, AI-generated text, and other information displayed within the Service. "Operator" means the individual identified above.

2. Nature of the Service

Z-Scope PRO is a cryptocurrency market data aggregation and intelligence dashboard. It provides informational and educational content only. The Service does not constitute financial, investment, tax, or legal advice. The Service does not execute trades, hold or manage funds, or act as a broker, exchange, custodian, or financial intermediary of any kind.

3. No Investment Advice — Risk Warning

All Content — including AI-generated analyses, alerts, confluence signals, edge scores, and market summaries — is for informational and educational purposes only and must not be construed as a recommendation to buy, sell, or hold any cryptocurrency or financial instrument. Cryptocurrency trading carries a high level of risk, including the risk of total loss of invested capital. You acknowledge that all investment and trading decisions are made at your sole risk and discretion. Past performance data shown on the platform is not indicative of future results. You should consult a qualified, licensed financial advisor before making any investment decision.

4. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. You are solely responsible for ensuring that your use of the Service complies with all laws and regulations applicable to you in your jurisdiction.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information during registration and to notify us immediately of any unauthorized access or security breach. The Operator reserves the right to suspend or terminate accounts that violate these Terms.

6. Acceptable Use

You agree not to: (a) reverse-engineer, decompile, scrape, crawl, or redistribute any data, code, or content from the Service; (b) use the Service for any unlawful purpose or in violation of any applicable laws; (c) attempt to gain unauthorized access to the Service, its servers, or related systems; (d) resell, sublicense, or commercially exploit access to the Service without prior written consent; (e) use automated tools (bots, scripts) to access the Service in a manner that exceeds reasonable personal use; (f) interfere with or disrupt the Service or impose an unreasonable load on infrastructure.

7. Intellectual Property

All intellectual property rights in the Service (including design, code, branding, and proprietary algorithms) belong to the Operator. Market data displayed within the Service is provided by third-party sources and is subject to those providers' respective terms. You retain ownership of any data you input into the Service (portfolio, watchlist, notes).

8. Third-Party Data and Services

The Service aggregates data from third-party providers including CoinGecko, Binance, DeFiLlama, Alternative.me, and others. We do not control, verify, guarantee, or assume responsibility for the accuracy, completeness, reliability, or timeliness of third-party data. Third-party services (Stripe, Supabase) are subject to their own terms and privacy policies. Links to external websites are provided for convenience only and do not imply endorsement.

9. AI-Generated Content

AI-generated content (market briefs, analyses, scores, alerts) is produced by third-party large language models and algorithmic processing. Such content may contain errors, inaccuracies, outdated information, or biases. AI-generated content does not reflect the personal views or recommendations of the Operator. It should be treated as one of many data points and must not be relied upon as the sole basis for any financial or investment decision.

10. Subscriptions and Payments

Paid subscriptions are billed on a recurring basis (monthly or annually, as selected). All payments are processed by Stripe. The Operator does not store or have access to your payment card details. Prices may change with 30 days' prior notice. You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access until the end of your current billing period.

11. Limitation of Liability

To the maximum extent permitted by applicable law, the Operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or relating to: (a) your use of, or inability to use, the Service; (b) any trading or investment decisions made based on Content provided by the Service; (c) any errors, inaccuracies, or omissions in third-party data or AI-generated content; (d) unauthorized access to or alteration of your data; (e) any interruption or cessation of the Service. In jurisdictions that do not allow exclusion of certain warranties or limitation of liability, the Operator's liability is limited to the maximum extent permitted by law. In no event shall the Operator's total aggregate liability exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. The Operator does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

13. Indemnification

You agree to indemnify and hold harmless the Operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any trading or investment decisions you make.

14. Termination

The Operator may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Disclaimer of Warranties, Indemnification, and Governing Law) shall survive.

15. Modifications to Terms

The Operator reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Your continued use of the Service after the effective date of modified Terms constitutes acceptance. If you do not agree to the modified Terms, you must stop using the Service.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved by the competent courts of the Czech Republic. If you are a consumer in the EU/EEA, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the Service and supersede all prior agreements and understandings.

This Privacy Policy describes how Z-Scope PRO ("we", "us", "the Service") collects, uses, stores, and protects your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Czech law (Act No. 110/2019 Sb.).

2. Data We Collect

Account data: Email address provided during registration, used for authentication and service communication.
User-generated data: Portfolio entries, watchlist items, alert configurations, trading journal entries, and preferences you voluntarily input into the Service.
Usage data: Pages visited, features used, session duration, error logs — collected to improve the Service and diagnose issues.
Technical data: Browser type and version, device type, operating system, IP address (anonymized where technically feasible), referring URL.
Payment data: Processed exclusively by Stripe. We receive only: transaction confirmation, subscription status, and the last four digits of your payment method for display purposes. We never receive or store full card numbers, CVV, or bank account details.

3. Legal Basis for Processing (Art. 6 GDPR)

(a) Performance of a contract (Art. 6(1)(b)): Processing necessary to provide the Service, manage your account, and process payments.
(b) Consent (Art. 6(1)(a)): Optional analytics and marketing communications. You may withdraw consent at any time.
(c) Legitimate interest (Art. 6(1)(f)): Security monitoring, fraud prevention, product improvement, and defending legal claims. Our legitimate interests do not override your fundamental rights.

4. How We Use Your Data

We use your data to: (a) provide, maintain, and improve the Service; (b) authenticate your identity and manage your account; (c) process subscription payments via Stripe; (d) send essential service communications (security alerts, billing notifications, Terms updates); (e) analyze aggregated, anonymized usage patterns to improve features; (f) detect and prevent fraud or abuse. We do not use your data for automated individual decision-making, profiling for marketing purposes, or targeted advertising.

5. Data Sharing and Sub-processors

We do not sell, rent, or trade your personal data. We share data only with the following third-party sub-processors, each operating under data processing agreements (DPAs) compliant with Art. 28 GDPR:
• Supabase Inc. (USA) — authentication and database hosting. Appropriate safeguards: Standard Contractual Clauses (SCCs).
• Stripe Inc. (USA) — payment processing. Stripe is PCI DSS Level 1 certified. Appropriate safeguards: SCCs.
• Hetzner Online GmbH (Germany) — server infrastructure. Data processed within the EU.
No data is shared with advertisers, data brokers, or marketing platforms.

6. International Data Transfers

Some sub-processors (Supabase, Stripe) are based in the United States. Transfers to countries outside the EU/EEA are protected by Standard Contractual Clauses (SCCs) adopted by the European Commission, supplemented by additional technical safeguards where appropriate.

7. Data Retention

We retain your personal data for as long as your account remains active and is necessary to provide the Service. Upon account deletion or your written request, your personal data will be erased within 30 days, except: (a) anonymized, aggregated analytics data (no longer personal data); (b) data we are legally required to retain (e.g., billing records under Czech tax law — up to 10 years per § 35 zákona č. 235/2004 Sb.).

8. Your Rights Under GDPR

You have the following rights regarding your personal data:
• Access (Art. 15): Request a copy of your personal data we process.
• Rectification (Art. 16): Request correction of inaccurate data.
• Erasure (Art. 17): Request deletion of your data ("right to be forgotten").
• Restriction (Art. 18): Request restriction of processing under certain conditions.
• Portability (Art. 20): Receive your data in a structured, machine-readable format.
• Objection (Art. 21): Object to processing based on legitimate interests.
• Withdraw consent (Art. 7(3)): Withdraw consent at any time, without affecting the lawfulness of prior processing.

9. Cookies and Tracking

We use only strictly necessary cookies required for the Service to function (authentication session tokens). These cookies are exempt from consent requirements under Art. 5(3) of the ePrivacy Directive. We do not use third-party tracking cookies, advertising cookies, social media pixels, or fingerprinting technologies.

10. Security Measures

We implement appropriate technical and organizational measures to protect your data, including: encrypted connections (TLS/HTTPS), row-level security in the database (Supabase RLS), secure authentication protocols, regular software updates, and access controls limiting data access to authorized personnel only.

11. Children's Privacy

The Service is not intended for individuals under 18 years of age. We do not knowingly collect personal data from minors. If we become aware that we have collected data from a minor, we will promptly delete it.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. The current version is always available at zscope.org.
